Turning Capability into Consequence: What Comes Next in Canada’s AML Evolution
Canada has built a stronger anti-money laundering (AML) framework, but success now hinges on turning capability into consequence, ensuring enforcement is effective, consistent, and deterrent.
AI and Predictive Analytics: The Next Step
AI and machine learning can vastly improve AML efforts by detecting risk before crimes occur. But in Canada adoption is low (only 29% beyond pilot stage) and regulatory uncertainty is stalling progress.
Solution: Regulatory sandboxes could enable safe experimentation, as seen in the UK.
Cryptocurrency: The Ongoing Blind Spot
Despite regulatory steps, crypto platforms remain inconsistently compliant, and unhosted wallets still evade oversight. Canada’s application of the FATF “Travel Rule” is incomplete, limiting effective enforcement.
Beneficial Ownership Transparency: A Work in Progress
A public registry is expected by late 2025, but lack of provincial standardization still allows for loopholes and jurisdiction shopping. There is a need for real-time, national, harmonized registry accessible to institutions and investigators.
Indigenous Financial Systems: Vulnerable and Under Supported
Indigenous credit unions and trusts face AML risks due to regulatory gaps and limited resources. Culturally appropriate training, technology funding, and co-developed AML policies to protect and empower Indigenous financial institutions is needed.
Prosecution Gap: Crime Still Pays
Despite rising suspicious transaction reports, prosecutions remain stagnant. While the US imposes billion-dollar AML fines; Canada’s fines are small and quiet. The new Canadian Financial Crimes Agency (CFCA) could close this gap, if properly funded and empowered.
Canada has the tools but tools don’t deter crime unless they’re used boldly and consistently. The next chapter requires:
- Aggressive enforcement
- Broad transparency
- Inclusive protection
- Real consequences
